Is this the end for LGR?

The Government's decision to withdraw local government reorganisation (LGR) decisions in four areas and review them everywhere else, came as a surprise. At the same time there is a weary familiarity to it. The Government makes a decision, insists on the robustness of their legal position, then about turns based on ‘new legal advice'. When this happened around the elections that were postponed then unpostponed earlier this year, I cited Marx's adage that ‘history repeats itself, first as tragedy then as farce'. Now we need to ask ourselves what comes beyond farce? The Theatre of the Absurd perhaps?At that time, I wrote that councils ‘deserve to have confidence that government will deliver on its side of the process and not just keep changing its mind'.Well, I think we can agree that the ship has sailed. Across the sector, there is real and profound anger. People have invested time, energy and money in working towards the new unitaries. Implementation teams stood up, programme directors and managers appointed, consultants hired and hearts and minds meetings held with staff and with members to engage them on the journey of creating new councils. It's hard not to feel that effort is wasted.I have spoken to many people across the sector, and there's no doubt the anger and frustration are real. Even those who are pleased to see these decisions withdrawn are still deeply unimpressed by the process, while those who did support them are seething. ‘Shambles', ‘debacle' and ‘poor' were some of the words from the more printable end of the reaction spectrum. Whatever happens next, the Government is going to have an uphill battle to persuade the sector of its good faith and its consistency of purpose. So what happens now? Is this the end for LGR, or is it simply a pause?Government insists that it's the latter. They say ‘We're pausing to reflect before implementing final decisions, following the Prime Minister's promise to listen to concerns raised by local people. Our commitment to reform and reorganisation hasn't changed.' How credible is this?At LGIU we think there are four potential scenarios.First, that's it. LGR is dead in the water (Surrey aside). Elections are going ahead on exiting boundaries in May 2027, and there just isn't time before a General Election. Second, partial LGR. Decisions change in some areas and go ahead in others. Third, the Government goes hard on a new Rewiring the State option. Leading with devolution and decisions about strategic authorities before Christmas and revisited LGR decisions following on from that (and linked to it through local deals).And of course, a fourth option is just muddled chaos, in which a combination of Parliamentary Recess and limited capacity in the Ministry of Housing, Communities and Local Government just means that nothing much happens and no decisions are forthcoming either way.Views in the sector are split. Some are optimistic that if the Government can make decisions by October and if we continue in the meantime with geography-neutral work, then we can get back on track for a 2029 vesting day. But most people think it's unlikely that we will get LGR done in this parliament.In reality, the scenarios above can all collapse into each other, and all face the same key obstacles.Do we just get trapped in a legal doom loop? What's to stop a fresh set of councils issuing legal challenges if they don't like any new LGR decisions? Given the Government's revealed tendency to back down, wouldn't you fancy your chances? There's a human factor: is it possible to ask officers and members to stand up LGR again after you've asked them to down tools? Will people be willing to put in the superhuman efforts we've seen so far?Can we sustain the delivery mechanics; the contracts, staffing, market capacity we need for LGR? Can all that be carried through a period of such significant uncertainty?Do we just get trapped in a legal doom loop? What's to stop a fresh set of councils issuing legal challenges if they don't like any new LGR decisions? Given the Government's revealed tendency to back down, wouldn't you fancy your chances? And finally, there's the raw political logic. Moving to larger unitaries generally means folding up cities and towns that have tended to vote Labour into larger rural areas that have tended to vote Conservative or Reform. Does a Labour government really want LGR enough to effectively abolish Labour local government in the South? That circle still must be squared.All of that, alongside rewiring the state means, I feel, that we're likely to see a focus on devolution with LGR slipping down the agenda or being pushed into the next parliament (only happening sooner if there's an early General Election). So maybe that's how it ends ‘not with a bang but a whimper'.Having said all that, let's finish with a spark of hope. Maybe something does come out of all this. A momentum that can't be entirely halted. Some chiefs are already focused on this: what we've learned from the process, where we have identified duplication and potential for collaboration, new relationships that set the scene for joint working, shared data and systems alignment. A bigger conversation about what type of local government we want and what it's for. All of this should be preserved and will add value to whatever comes next.
