Keeping the lid on personal data

The loss of child benefit records last autumn as well as more recent data mishaps raises the question, ‘What if it happens to a local authority, especially with child records?’ Simon Charlton looks at the legal issues

When things go wrong, the information commissioner will investigate your policies and systems. If a local authority is found wanting, it can be publically embarrassing and potentially very expensive, and you may be subject to enforcement and regular inspections. All local authorities need to take this seriously, and ensure that they have policies in place to minimise the risk of system failures, and the unwelcome attention of the media and the Information Commissioner's Office.
