Unitary councils being created in 2029 face a ‘material uncertainty' over their opening budgets after the Government pushed back reorganisation, a senior finance officer has warned.Ministers last week insisted they were ‘committed to seeing local government reorganisation [LGR] through' as they announced an April 2029 vesting day for 20 areas.Preferred geographies were revealed for five areas – East Sussex and Brighton & Hove, Gloucestershire, Oxfordshire, Warwickshire and Worcestershire – that matched earlier decisions almost word for word, with outcomes for the remaining 15 areas expected either before Christmas or early in the new year.In messages posted during a Ministry of Housing, Communities and Local Government (MHCLG) call with councils, seen by The MJ, one section 151 officer warned civil servants that moving vesting day to 2029 had a ‘real financial consequence' with local authorities having to ‘remain financially sustainable through both 2027-28 and 2028-29' while also funding reorganisation.They added: ‘More importantly, the first year of the new unitary, 2029-30, is now outside both the existing three-year local government settlement and the current Spending Review period. That creates a material uncertainty around the new council's opening funding position.'The senior officer urged the Government to recognise the additional cost created by the delay, ‘deal explicitly' with pressures such as SEND and social care and give ‘early funding certainty' for 2029-30.A council chief executive warned that if vesting day did take place in April 2029 ‘supporting business cases will be based on almost five-year-old data'.Speaking to council chiefs and leaders, local government minister Jim McMahon is believed to have explained the decision to delay shadow elections from 2027 would avoid the chance of judicial reviews further disrupting the overhaul and provide ‘certainty and clarity'.However, the Government's attempt to reduce the chances of legal challenge have been questioned, with one sector figure telling officials: ‘As an ex-monitoring officer, it seems as dodgy as hell to me.'Norfolk CC deputy leader Cllr Robin Hunter-Clarke claimed that during a call with councils, McMahon ‘openly challenged councils to bring another judicial review if we disagreed with the Government's approach'.He called this an ‘astonishing way to engage with local government', adding: ‘Instead of working collaboratively with councils, ministers appear to now be inviting legal battles.'In a statement, a spokesperson for McMahon said: 'The Government is focused on rebuilding trust and confidence in the LGR programme, and we have engaged extensively with local government leaders to achieve that.'This account of the meeting is nonsense and unhelpful. Jim made clear that ministers want to satisfy themselves that the process is robust and build confidence in the event that a decision is subsequently challenged. He also acknowledged that, whatever the outcome, some councils might still seek to challenge it, as they can any government decision.'But, to be clear, we hope leaders will put their effort and resources into making LGR work for local people, and that any representations are made through the minded to process we have put in place.'
